Terms of Use
These Terms of Use (“Terms”) form an agreement between you and the provider of MaxSecure (“we,” “us,” or “our”) concerning your access to and use of the MaxSecure application (the “App”). By downloading, installing, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be legally capable of entering into these Terms where you live. If you have not reached the applicable age of majority, you may use the App only with the involvement and permission of a parent or legal guardian, to the extent permitted by law.
2. Apple App Store Terms
If you download MaxSecure from the Apple App Store, your use of the App is also subject to Apple’s Standard Licensed Application End User License Agreement and applicable App Store terms. These Terms are between you and us, not Apple.
3. License to Use MaxSecure
Subject to these Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable license to install and use MaxSecure on Apple-branded devices that you own or control, for your private, non-commercial use and as permitted by Apple’s usage rules.
No ownership rights are transferred to you. We and our licensors reserve all rights not expressly granted under these Terms.
4. App Features
MaxSecure may allow you to:
- review photos and videos by categories such as similar, blurry, screenshots, large media, Live Photos, and screen recordings;
- select photos and videos and request cleanup actions;
- review photos by month using keep-or-trash swipe actions;
- place selected photos and videos in a PIN-protected Private Space;
- preview, export, and delete media using the controls made available in the App;
- view device-storage and reviewable-media estimates.
Features may depend on your device, iOS version, available storage, Photo Library contents, permissions, and Apple services. Screens, classifications, estimates, and feature availability may change as we maintain and improve the App.
5. Permissions and Your Choices
MaxSecure requires Photo Library access for media review, categorization, preview, import, export, and deletion functions. You decide whether to grant access and, where iOS offers the option, which photos and videos the App may access. You can change access in iOS Settings, but limiting access may prevent features from operating correctly.
The App may invoke Apple’s device authentication when you request a PIN reset. Apple performs the authentication. You remain responsible for protecting your device passcode, biometric access, and MaxSecure PIN.
6. Photo and Video Analysis
MaxSecure uses on-device technical rules to group or identify media that may be similar, blurry, a screenshot, large, a Live Photo, a screen recording, or otherwise relevant to a review category. These results are estimates and recommendations. They may be incomplete, inaccurate, or different from how you would classify the same content.
Always review previews, selections, item counts, and storage estimates before confirming an action. MaxSecure does not replace your judgment about which photos or videos are important, redundant, or safe to remove.
7. Cleanup and Deletion
You make the final decision to delete media. MaxSecure does not intentionally delete Photo Library content without the action and system confirmation required by iOS. Before confirming a deletion, check that selected items do not include content you want to keep.
Apple Photos may move deleted photos and videos to the Recently Deleted album rather than erasing them immediately. Such items may continue to use storage until they are permanently removed or Apple deletes them after the period shown in Photos. Content may become permanently unrecoverable once removed from Recently Deleted.
Cleanup results and storage estimates may not update immediately because of iOS behavior, iCloud synchronization, caching, or other processes outside MaxSecure’s control. We do not guarantee that a particular action will free a particular amount of space.
8. Swipe Review and Trash
Moving a photo to Trash while using the App’s Swipe feature records your decision in MaxSecure and stages the item for later review. It does not by itself guarantee permanent deletion from Apple Photos. A separate confirmation may be required before iOS processes the deletion request.
Review staged items before confirming deletion. Closing the App, reinstalling it, clearing its data, or encountering a software or device error may affect local swipe and Trash state.
9. Private Space
Private Space lets you import selected photos and videos into storage controlled by the App and restrict access through a four-digit PIN. It is intended as an organizational and access-control feature, not as a guaranteed secure vault, archival system, or backup service.
Importing content into Private Space may leave the original in Apple Photos unless you separately choose and confirm deletion through the available flow. Exporting content may create an additional copy in Apple Photos while retaining the Private Space copy. You are responsible for checking where copies remain.
Removing the App, clearing its data, losing or damaging your device, or performing certain device restores may permanently remove Private Space content. Keep independent backups of important media in a location you trust. We are not able to retrieve locally stored Private Space content from a MaxSecure server.
10. PIN and Device Authentication
You are responsible for remembering and protecting your MaxSecure PIN. Do not share it. Anyone with access to your unlocked device, device authentication, or PIN may be able to access or change Private Space content.
If you use “Forgot PIN?”, MaxSecure may rely on Apple’s device authentication before allowing you to create a new PIN. This flow does not restore deleted content, create a backup, or guarantee recovery if device authentication is unavailable.
11. Your Responsibilities
You agree that you will:
- use MaxSecure only with photos, videos, and devices you are authorized to access;
- review all selections before confirming deletion, export, or other changes;
- maintain appropriate backups of content you cannot afford to lose;
- keep your device, device credentials, and MaxSecure PIN secure;
- comply with applicable laws and respect the privacy, intellectual property, and other rights of others.
12. Acceptable Use
You must not:
- copy, modify, distribute, sell, lease, sublicense, or commercially exploit the App except as expressly permitted by law;
- reverse engineer, decompile, disassemble, or attempt to discover source code, except where applicable law expressly permits it;
- circumvent or interfere with security, access controls, technical restrictions, or Apple platform protections;
- introduce malicious code, disrupt the App, or use the App to harm another person, device, or service;
- use the App for an unlawful, fraudulent, infringing, abusive, or unauthorized purpose;
- misrepresent your relationship with MaxSecure or use our branding without permission.
13. Intellectual Property
MaxSecure, including its software, interface, design, text, graphics, logos, and other materials, is owned by us or our licensors and is protected by intellectual property and other laws. Your photos and videos remain yours or subject to the rights of their respective owners. These Terms do not grant us ownership of your media content.
14. Third-Party Services
MaxSecure operates on Apple devices and relies on Apple technologies such as iOS, Photo Library permissions, Apple Photos, iCloud behavior, and device authentication. Third-party services are governed by their own terms and policies. We are not responsible for third-party services, outages, changes, or data practices.
15. Privacy
Our Privacy Policy explains how information is handled when you use MaxSecure and is incorporated into these Terms by reference.
16. Subscriptions, Billing, and Cancellation
16.1 Subscription Access
MaxSecure may offer certain premium features through auto-renewable subscriptions purchased through Apple’s App Store. The features included, subscription duration, price, and any introductory offer will be displayed before you confirm your purchase.
16.2 Payment
Payment will be charged to your Apple Account when you confirm your purchase, unless the offer specifies a free trial or a later billing date. Apple processes App Store payments under its applicable terms.
16.3 Automatic Renewal
Subscriptions renew automatically unless canceled before renewal. To avoid the next renewal charge, cancel at least 24 hours before the current subscription period ends. Your Apple Account may be charged for renewal within the 24 hours before the next period begins, at the applicable renewal price.
16.4 Free Trials and Introductory Offers
If a free trial or introductory offer is available, its eligibility requirements, duration, and subsequent subscription price will be shown before you subscribe. Unless you cancel in time, the subscription will automatically continue at the price and billing interval disclosed when you accepted the offer. To avoid being charged after a free trial, cancel at least 24 hours before the trial ends.
16.5 Managing and Canceling Your Subscription
You can manage or cancel your subscription on your iPhone by opening Settings, tapping your name, selecting Subscriptions, and choosing MaxSecure.
Deleting the App or stopping use of MaxSecure does not cancel your subscription. After cancellation, paid subscription access generally continues until the end of the period already paid for, unless Apple’s terms or applicable law provide otherwise. For trials, the effective cancellation date and remaining access are governed by the offer terms and the information shown by Apple. Once your subscription expires, features requiring an active subscription will no longer be available.
16.6 Restoring Purchases
To restore an eligible subscription, sign in with the same Apple Account used for the original purchase and use the restore-purchases option available in the App. Restoration is subject to verification of your purchase and current subscription status. Restoring a purchase does not restart a trial or extend an expired subscription. If you cannot restore eligible access, contact MaxSecure Support.
16.7 Refunds
For purchases billed by Apple, you can request a refund through Apple’s refund portal. Refund eligibility and processing are subject to Apple’s policies and applicable law. Canceling a subscription does not itself request or guarantee a refund. Nothing in these Terms limits any mandatory consumer rights you may have.
16.8 Price Changes
Subscription prices may change to reflect changes in service features, operating costs, taxes, or exchange rates. Any change affecting an existing subscription will follow Apple’s notification and consent requirements and applicable law. You may cancel before the new price takes effect if you do not wish to continue.
17. App Changes, Availability, and Termination
We may update, change, suspend, restrict, or discontinue any part of MaxSecure to maintain security, comply with law, address technical issues, or improve the App. We do not guarantee that every feature will remain available or compatible with every device or iOS version.
You may stop using MaxSecure at any time. Stopping use of the App does not cancel an active subscription; please follow the cancellation instructions in Section 16. We may terminate or restrict your license if you materially violate these Terms. On termination, you must stop using the App. Provisions that by their nature should survive will remain in effect, including intellectual property, disclaimers, limits of liability, indemnity, and general terms.
18. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, MAXSECURE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND QUIET ENJOYMENT.
WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR COMPATIBLE WITH EVERY DEVICE; THAT MEDIA CATEGORIES, COUNTS, OR STORAGE ESTIMATES WILL BE ACCURATE; OR THAT CONTENT CAN BE RECOVERED AFTER DELETION, DEVICE LOSS, APP REMOVAL, DATA CORRUPTION, OR OTHER EVENTS.
Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, the exclusions apply only to the maximum extent permitted by law, and you may have additional statutory rights.
19. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, LICENSORS, PERSONNEL, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF DATA, PHOTOS, VIDEOS, PRIVACY, PROFITS, OR GOODWILL; OR THE COST OF SUBSTITUTE SERVICES ARISING FROM OR RELATED TO MAXSECURE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
To the fullest extent permitted by law, our total liability for all claims arising from or related to the App or these Terms will not exceed fifty U.S. dollars (USD 50). If applicable law does not permit this limit, liability will be limited to the maximum extent permitted by law. Nothing in these Terms excludes liability that cannot lawfully be excluded.
20. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless us and our affiliates, licensors, personnel, and service providers from claims, losses, liabilities, damages, and reasonable costs arising from your unlawful use of MaxSecure, your violation of these Terms, or your infringement of another person’s rights. This obligation does not apply to the extent a claim results from our own unlawful conduct.
21. Export and Sanctions Compliance
You may not use, export, or re-export MaxSecure except as permitted by applicable export-control and sanctions laws. You represent that you are not prohibited from receiving or using the App under such laws.
22. Mandatory Rights
Any non-waivable consumer-protection, privacy, and other mandatory rights available where you live remain in effect.
23. Changes to These Terms
We may update these Terms when MaxSecure, our practices, or legal requirements change. We will post the revised Terms and update the “Last updated” date. If a material change requires additional notice or consent under applicable law, we will provide it. Your continued use after revised Terms take effect constitutes acceptance to the extent permitted by law.
24. General Terms
- Entire agreement: These Terms and the Privacy Policy are the entire agreement concerning your use of MaxSecure, except for mandatory Apple terms.
- Severability: If a provision is found unenforceable, it will be modified only as much as necessary, and the remaining provisions will continue in effect.
- No waiver: A delay or failure to enforce a right does not waive that right.
- Assignment: You may not assign these Terms without our consent. We may assign them as part of a merger, reorganization, transfer of assets, or by operation of law.
- Headings: Section headings are for convenience and do not limit the meaning of these Terms.
